Supreme Court Sides With Idaho Property Owners In Priest Lake-Area Wetland Case

WASHINGTON — The Supreme Court has sided with an Idaho couple in a property rights case, ruling they can go to court to challenge an Environmental Protection Agency order that blocked construction of their new home and threatened fines of more than $30,000 a day.

Wednesday's decision is a victory for Mike and Chantell Sackett, whose property near a scenic lake has sat undisturbed since the EPA ordered a halt in work in 2007. The agency said part of the property was a wetlands that could not disturbed without a permit.

In an opinion by Justice Antonin Scalia, the court rejected EPA's argument that allowing property owners quick access to courts to contest orders like the one issued to the Sacketts would compromise the agency's ability to deal with water pollution.

"Compliance orders will remain an effective means of securing prompt voluntary compliance in those many cases where there is no substantial basis to question their validity," Scalia said. In this case, the couple objected to the determination that their small lot contained wetlands that are regulated by the Clean Water Act, and they complained there was no reasonable way to challenge the order without risking fines that can mount quickly.

Video: Woman Evicted From Home Without Due Process of Law

This is a very disturbing audio, recorded live on May 12, 2009 when a woman named Dawn was forcibly evicted from her home on the orders of a Judge who failed to provide her with due process of law.  He totally denied Dawn her day in court.

Dawn was challenging the Bank's assertion that it had any valid claim to her property, having secured her original note which showed it had been paid in full.    The court's jurisdiction in the matter was also being challenged.  The judge decided to ignore the rule of law and ordered Dawn and her family to be forcibly removed from her property.

The events that followed after the eviction were equality appalling as once officer told Dawn something to the effect, "you're in Hillsboro County.  You have no rights."

Video: Stop Foreclosure - Demand Banks Produce The Note!

Banks have sold and resold, chopped up and repacked mortgages so many times a huge number of banks no longer actually have any legal claim to property they foreclose on. It's time we stop the banks from literally stealing property they have no right to take. They get away with it because most people have no idea the fraud that is being committed against them and because most people do not have any legal representation or due process of law.
